Kober Childcare attaches great importance to the protection of your personal data. In this Privacy Statement, we provide clear and transparent information about how we handle personal data.

We do everything we can to protect your privacy and therefore handle personal data with care. Kober childcare complies with all applicable laws and regulations, including the General Data Protection Regulation. This means that we:

  • Process your personal data in accordance with the purpose for which it was provided. These purposes and types of personal data are described in this Privacy Statement;
  • Limit the processing of your personal data to only those data that are minimally necessary for the purposes for which they are processed;
  • Ensure that, in principle, only employees at your child's childcare location have access to your personal data. If your child moves to a different Kober location (for example, if they transfer from daycare to after-school care), the employees at this new location will also be able to view their personal data (as of January 1, 2024).
  • Ask for your explicit consent if we need it for the processing of your personal data;
  • Have taken appropriate technical and organizational measures to ensure the security of your personal data;
  • Do not pass on personal data to other parties, unless this is necessary for the implementation of the purposes for which they were provided;
  • To be aware of your rights regarding your personal data, to point this out to you and to respect them.

Why are we allowed to process personal data of customers or employees?

Kober childcare processes your personal data based on the following legal grounds for providing childcare. These include:

  • The processing is necessary to perform the agreement we have concluded with you;
  • The processing is necessary to comply with a legal obligation, such as providing personal data to the Tax Authorities, Municipal Health Service (GGD) and Pension Fund;
  • The processing is necessary to protect data subjects in the event of, for example, allergies in children;
  • The processing is necessary in connection with our legitimate interest to monitor and improve the quality of our services, for example by using coaches and video recordings and conducting customer surveys.
  • We also use camera images to secure our building;
  • If you have given consent for processing, such as publishing photos on social media, for example, you can always withdraw this consent for future processing.

Special personal data

Sensitive data such as a person's race, health, sexual orientation, political beliefs, and/or religious beliefs are considered special personal data and are afforded additional protection by law. Kober childcare only processes special personal data if the data subject has given consent for the processing of this special personal data. This may occur in the following situations, among others:

  • Health data of children that are important for good and safe childcare;
  • Kober childcare does not process employee medical data. However, the company doctor is authorized to do so within the framework of sickness absence management.

 

Why and for what purpose do we process personal data?
Kober Childcare collects and processes data from clients (parents and children) and employees. Employees are defined as anyone who performs work on behalf of Kober Childcare. We process and collect data to perform our duties and thus implement the agreed-upon agreement. Personal data is processed for the following reasons:

  • Data that are important for the care, support and development of the child
  • Contact with parents, guardians and legal representatives of children
  • Applying for subsidies
  • (Financial) settlement of the agreement
  • Processing of personal data for personnel administration

Kober childcare stores your personal data for the above-mentioned processing(s) for the duration of the agreement and thereafter only in the financial and/or personnel administration for a maximum of 7 years.

Processing of personal data of customers

To fulfill the agreement we have with you, we need to process your personal data. The information we need for this is your first name, middle name, last name, address, postal code, city, date of birth (of your child), telephone number, email address, gender, copy of your ID, citizen service number (BSN), and bank details.

Kober childcare stores your personal data for the aforementioned processing(s) for the duration of the agreement and thereafter only in the financial administration for a maximum of seven years. We use our customers' contact information to send service emails and commercial information, such as newsletters and event invitations. You can unsubscribe from these emails at any time by sending an email to privacy@kober.nl. We will use your contact information for a maximum of one year after the end of our agreement with you.

If you call our service team or accounts receivable department…

We may record conversations you have with members of our service team and accounts receivable department for training purposes. We process recordings solely for this purpose and retain them for no longer than necessary. The retention period is a maximum of 90 days.

If we record a conversation, we will always inform you of this beforehand via a recording. This processing is necessary for our legitimate interest in monitoring and improving the quality of our service to you.

Processing personal data of employees

To fulfill the employment contract we have with you, we need to process your personal data. The data we need for this purpose are your first name, first name, middle name, last name, telephone number, email address, date of birth, place of birth, address, postal code, city of residence, a copy of your ID, citizen service number (BSN), and bank details. We also process data for the further execution of the employment contract, such as interview reports. Data related to disability is processed by an external occupational health and safety service. Kober childcare asks employees to provide a passport photo for the intranet, for identification on location, and—in certain roles—for the external website. The employee gives written consent for this.

Kober childcare stores your personal data for the above-mentioned processing during the period you are employed with us and thereafter only in the financial and personnel administration for a maximum of 7 years.

We do not use the camera footage recorded at our office to monitor our staff. Therefore, we will not review it unless an incident has occurred.

Provision to third parties

We may share (part of) the data you provide to us with third parties if this is necessary for the purposes described above. For example, we use a third party for:

  • Implementation of our business administration; Tax Authorities, Pension Fund, Municipal Health Service (GGD), Employee Insurance Agency (UWV) and municipalities
  • Collection and administration
  • Customer and employee research
  • Digital signature
  • Warm handover to primary schools
  • Processing of the absence administration by an external occupational health and safety service

We enter into Data Processing Agreements with parties who process personal data on our behalf. We naturally make the necessary arrangements with these parties (processors) to ensure the security of your personal data. Furthermore, we do not provide the data you provide to other parties unless legally required and permitted. For example, the police may request (personal) data from us as part of an investigation, or the Municipal Health Service (GGD), which monitors our compliance with the Childcare Act. In such a case, we must cooperate and are therefore obligated to provide this data. We may also share personal data with third parties if you give us written permission to do so.

Within the EU

In principle, we do not provide personal data to parties located outside the EU. The content of our social media channels (such as Facebook and Google) is based in the United States. This is subject to the conditions imposed by law, for example, through the applicability of the EU Model Clauses. For more information, please consult the privacy statements of these parties.

Storage period

Kober childcare does not retain personal data longer than necessary for the purpose for which it was provided or as required by law. In principle, we do this only for the duration of the agreement and thereafter in our financial and personnel records for a maximum of 7 years. We retain camera footage recorded in our building for no longer than 10 days.

Security

We have implemented appropriate technical and organizational measures to protect personal data against unlawful processing. For example, we have implemented the following measures:

  • All persons who can access your data on behalf of Kober childcare are bound by confidentiality. All employees who require access in order to perform their duties have access to the data.
  • We have a username and password policy on all our systems;
  • We anonymize and encrypt personal data if there is reason to do so;
  • We make backups of personal data in order to be able to restore them in the event of physical or technical incidents;
    We regularly test and evaluate our measures;
  • Our employees have been informed about the importance of the protection of personal data.

Rights regarding your data

You have the right to access, rectify, or erase the personal data we have received from you. You can also object to the processing of your personal data (or part thereof) by us or one of our processors. You also have the right to have the data you provided transferred to you or, on your behalf, directly to another party. We may ask you to identify yourself before responding to the aforementioned requests.

If we may process your personal data based on your consent, you always have the right to withdraw this consent.

Complaint

Do you have a complaint about the processing of your personal data? Please contact us directly. If we cannot reach an agreement, we are, of course, very sorry. You always have the right to file a complaint with the Dutch Data Protection Authority, the supervisory authority for privacy protection.
